Upper Township Planning Board
PLEASE TAKE NOTICE that the Upper Township Planning Board (the “Board”) will hold a public hearing on September 3, 2026 at 6:00 PM at Upper Township Hall, 2100 Tuckahoe Road, Petersburg (Upper Township), New Jersey, 08270, to review and take formal action upon an application for Amended Preliminary and Final Major Site Plan, d(1) use variance and/or d(2) use variance for expansion of non-conforming use (the “Application”) by Foglio Family, LLC (the “Applicant”) with respect to property having a street addresses of 342 and 344 Route US 9 South, Marmora (Upper Township), New Jersey, 08223 and being designated as Block 600, Lot 40, on the Upper Township Tax Map (the “Property”). The Property is approximately 4.36 acres and is located in the Township’s MTCD Marmora Town Center District Zone.
The Property is currently improved with three buildings which operate as a Flooring Outlet, including one storage building. Additionally, pursuant to the Prior Approval (further described herein), the Property contains a 5,000 SF storage building for the Foglio family and businesses which operate on the Property.
By Resolution BA 13-2022, memorialized October 13, 2022, the Upper Township Zoning Board of Adjustment approved Applicant’s application for preliminary and final major site plan approval, d(2) use variance for expansion of non-conforming use and to have multiple primary uses on the Property, and bulk variance/design waiver relief to construct two 50’ x 100’ storage/warehouse buildings (the “Prior Approval”). One of those storage buildings has been constructed. If deemed necessary, Applicant requests an extension of the Prior Approval to construct the second 50’ x 100’ storage/warehouse building.
As a condition of the Prior Approval, Applicant was required to provide two (2) two-bedroom on-site affordable housing (COAH) units. In this application, Applicant seeks amended Preliminary and Final Site Plan approval, d(1) use variance and/or d(2) use variance for expansion of non-conforming use, and a modification of the prior condition to remove the requirement to construct the two on-site COAH units.
The Applicant also seeks any additional deviations, exceptions, design waivers, submission waivers, variances, use variances, conditional use variances, interpretations, continuations of any pre-existing non-conforming conditions, modifications of prior imposed conditions and other approvals reflected on the filed plans (as same may be further amended or revised from time to time without further notice) and as may be determined to be necessary during the review and processing of the Application.
When this case is called, interested parties may appear, either in person or by attorney, and present any comments or questions which they may have regarding this Application. Formal action by the Board may be taken. The public hearing may be continued by the Board to a subsequent date or dates by way of public announcement made at the public hearing either with or without further published notice, as the Board may determine.
At least ten (10) days prior to the hearing, the Application and supporting materials (including maps and plans), and resolution of Prior Approval will be available for public inspection during normal working business hours in the office of the Board Secretary, located at 2100 Tuckahoe Road, Petersburg, New Jersey.
