Application before the Ocean City Planning Board
PLEASE TAKE NOTICE that on Wednesday, October 14, 2026 at 6:00 p.m., a public hearing will be held before the Planning Board of the City of Ocean City in the Council Chambers, Third Floor, City Hall, 861 Asbury Avenue, Ocean City, New Jersey 08226, on the application of Duncan Real Estate Investments, LLC (the “Applicant”), Application No. PBA 26-012, concerning the property located at 801-803 Wesley Avenue, Ocean City, New Jersey, designated as Block 804, Lot 9 on the Tax Map of the City of Ocean City (the “Property”). The Property is located in the Central Business (CB) Zone.
The Applicant proposes to demolish the existing commercial building on the Property, subdivide the Property into two (2) lots of approximately 50 feet by 105 feet (5,250 square feet) and construct a three-story mixed-use building on each new lot, each consisting of ground-floor commercial space with three (3) residential dwelling units on the second and third floors, together with off-street parking and related site improvements. The Applicant seeks the following approvals and relief: (1) minor subdivision approval; (2) preliminary and final major site plan approval; (3) conditional use approval for the proposed residential units; and (4) variance relief from the following: (a) minimum lot area, width and frontage for the interior and corner lots; (b) minimum commercial floor area (c) minimum parking space setback from the property line (d) minimum parking space setback from the building (e) to permit front porches and decks. The Applicant also seeks design waivers and waivers from the minor subdivision and site plan submission checklist requirements. The Applicant also requests any and all other variances, waivers, exceptions, interpretations and approvals that the Board may deem necessary or appropriate to permit the proposed development.
When the matter is called, you may appear either in person or by attorney and present any support or objection which you may have to the granting of the relief and approvals sought. The application, plans and all other documents relating to this matter will be available for public inspection at least ten (10) days prior to the hearing date, during normal business hours, in the office of the Planning Board Secretary, Henry Knight Building, 115 12th Street, Ocean City, New Jersey 08226.
